Cunha and Hildelano Delanusse Theodoro, and was published with D'Plácido Editoria in 2014.
Johan P. Olsen's contribution is a translation of an article published in Journal of Political Philosophy in 1997, entitled 'Institutional Design in Democratic Contexts'.
Institutional design in democratic contexts
Johan P. Olsen's chapter considers the design and redesign of political institutions. Specifically, it discusses how the significance of design may be affected by key institutional features of contemporary democratic polities. The first question is: To what degree do democratic contexts create a viable space for institutional design – making design necessary, politically feasible and legitimate? The second question is: What kind of processes tend to make designers able to exploit the available space of design?
The chapter aims at going beyond the idea that design can best be understood as a process of problem-solving or power-struggle over policy-benefits in terms of pre-defined preferences and powers. It argues that design is more likely when designers exploit shifting political attention and the confluence of temporary, favorable circumstances; when they stabilize attention over extended periods; and when they trigger self-driving processes that make design independent of one-shot, grand decisions that change an institutional arrangement at once. Design is, furthermore, more likely when political actors evoke aspects other than an institution's instrumental value–in particular deontological concerns. Finally, design is more likely when political actors take into account how the working of institutions depends on properties of the citizens, not only rules and incentives; and when they take into account how institutions fashion, not only regulate, citizens.

Ao se completarem os 25 anos da Constituição e um tempo razoável de funcionamento dessas instituições da democracia, algumas avaliações têm sido feitas, seja sobre seus resultados efetivos, seja sobre a sua adequação ao contexto atual, a partir de diversos parâmetros. O desenho institucional é uma das possiblidades de abordagem, ainda que seja insuficiente para uma análise completa, uma vez que outros fatores certamente interferem nos resultados e no desempenho das instituições. Ainda assim, considera-se que um primeiro empreendimento deve ser o de compreender o formato e as regras que balizam essas instituições, orientadas por princípios e valores que se espera sejam por elas efetivados. Neste sentido, este livro é um esforço coletivo de refletir sobre as inovações democráticas brasileiras a partir de uma referência comum: a relação entre desenho institucional, democracia e participação.
